These Terms of Service ("Terms") govern your access to and use of the software products operated by Camel Creatives ("we", "us", "our"), including Ziada POS, Tengeneza CV, SendAfrica, CamelPay, Fupisha, Ngamia, Ngamia Music, Harusi, Ngamia Invoice, MailAfrica, and Biashara AI (collectively, the "Services"). By creating an account or using any Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your country) to use our Services. You represent that you meet this requirement and that information you provide is accurate.
2. Your Account
- You are responsible for maintaining the confidentiality of your login credentials.
- Camel Accounts lets one sign-in work across multiple Camel Creatives products.
- Notify us immediately of any unauthorized use of your account.
- We may suspend or terminate accounts that violate these Terms.
3. Acceptable Use
You agree not to use the Services unlawfully, attempt unauthorized access, disrupt the Services, send spam or fraudulent messages, or reverse-engineer any Service except where permitted by law.
4. Payments and Mobile Money
Some Services process payments via mobile money or card through providers such as CamelPay. Transaction fees, currency conversion, and provider-specific terms may apply. We are not responsible for delays or failures caused by third-party providers.
5. Service Availability
We aim to keep our Services available and reliable, but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of a Service with reasonable notice where practical.
6. Intellectual Property
All software, designs, logos, and content associated with the Services are owned by Camel Creatives or its licensors. You may not copy, modify, or distribute any part without prior written consent.
7. Third-Party Services
Some Services integrate with third-party platforms. Your use of those integrations may also be subject to the third party's own terms and privacy policies.
8. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, including fitness for a particular purpose, non-infringement, or uninterrupted operation.
9. Limitation of Liability
To the maximum extent permitted by law, Camel Creatives shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services.
10. Termination
We may suspend or terminate access to any Service, including for violation of these Terms. You may stop using the Services and request account deletion at any time.
11. Governing Law
These Terms are governed by the laws of the United Republic of Tanzania. Disputes shall be subject to the exclusive jurisdiction of the courts of Tanzania.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
